These Terms govern your use of WillingGivers.org, whether as a donor, campaign creator, or visitor. Please read them carefully.

1. About WillingGivers

WillingGivers is a nonprofit crowdfunding platform designed to empower individuals, communities, and organizations to raise funds for charitable causes. We help connect those in need with those willing to give.

2. Eligibility

To use our services:

• You must be at least 18 years old or have legal parental/guardian consent.
• You must agree to abide by all applicable laws and these Terms.
• You may not use the Platform if you have been suspended or removed from it in the past.

3. User Accounts

When creating an account on WillingGivers, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security and confidentiality of your account credentials.
• Accept responsibility for all activity under your account.
• Notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate your account for any violations of these Terms or suspicious activity.

4. Creating a Campaign

As a campaign creator, you are responsible for:

• Clearly describing your fundraising goals and how the funds will be used.
• Providing truthful, accurate, and up-to-date information.
• Ensuring that all donations are used solely for the purposes stated in your campaign.
• Complying with all local, national, and international laws applicable to charitable fundraising.

WillingGivers reserves the right to remove any campaign that violates these Terms or appears fraudulent, misleading, or inappropriate.

5. Donations and Payments

Donations made through WillingGivers are:

• Voluntary and non-refundable unless otherwise required by law.
• Processed through trusted third-party payment gateways (e.g., Stripe, PayPal).
• Subject to small transaction or platform fees that help maintain the service.

WillingGivers does not guarantee that campaign creators will use the funds as promised. Donors are encouraged to review each campaign thoroughly before contributing.

6. Use of Platform

You agree not to:

• Misuse the Platform or engage in fraudulent or deceptive behavior.
• Upload or share harmful, offensive, or illegal content.
• Infringe on the intellectual property rights of others.
• Attempt to gain unauthorized access to the Platform or its systems.

We reserve the right to monitor activity and remove or suspend content or users who violate our terms.

7. Data and Privacy

We collect and use personal information in accordance with our Privacy Policy.
This includes:

• Name, email, and profile information for account setup.
• Campaign and donation details for processing.
• Device, browser, and usage data for analytics and security.

We do not sell or share our personal data with third parties without your consent, unless legally required.

8. Content Ownership and Use

All content you submit (images, videos, text) remains your property, but by submitting it, you grant WillingGivers:

• A non-exclusive, royalty-free license to use, display, and promote your content for platform-related purposes.

You are solely responsible for ensuring that your content does not infringe on others’ rights.

9. Termination

You may close your account at any time. We reserve the right to suspend or terminate your access to the Platform at our sole discretion, especially if:

• You violate any part of these Terms.
• Your behavior poses risk or harm to users or the organization.

Upon termination, any funds not yet disbursed may be withheld or returned depending on the situation and our legal obligations.

10. Limitation of Liability

WillingGivers provides its services on an “as is” and “as available” basis. We do not guarantee:

• That campaigns will reach their goals or funds will be used as stated.
• Continuous, secure, or error-free access to the Platform.

To the fullest extent permitted by law, WillingGivers is not liable for:

• Any damage, losses, or liabilities arising from your use of the Platform.
• Campaign misuse, donor disputes, or platform outages.

11. Indemnification

You agree to indemnify and hold harmless WillingGivers, its employees, directors, and affiliates from any claims, losses, or damages arising from:

• Your use of the Platform,
• Your violation of these Terms,
• Your infringement of any rights of a third party.

12. Changes to the Terms

We may update these Terms from time to time. If we make significant changes, we’ll notify you through the Platform or by email. Continued use of the Platform after updates means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved through arbitration or courts located in Seattle.
